Emmyco (“we,” “us” or “Emmyco”) operates the www.emmyco.com website (“Platform”). This Privacy Statement (“Statement”) describes the types of information we collect and how we use and share the information.
ACCEPTANCE OF STATEMENT; MODIFICATIONS
We may change this Statement by posting an updated version on our Platform, without notice to you. The updated Statement will be effective immediately upon posting, and apply to all access and use of our Platform thereafter. If we decide that it is appropriate, we may provide additional notice of more significant changes. By continuing to use our Platform after we post an updated Statement, you agree to be bound by the updated Statement. Please check this Statement regularly so you are aware of any changes.
Personal Information We Collect
We collect personally identifiable information about you only when you voluntarily provide it to us (e.g., when registering for a User or emmy account, requesting Trip Accompaniment, completing online forms or applications, signing up to receive newsletters or requesting transaction documents). The information you provide to us may include information that personally identifies you, such as name, email address, username, password, phone number and mailing address (“Personal Information”). You may provide information when you register as a User, register to become an emmy, or communicate with us through our Platform, email, text (SMS) messaging, over the telephone, in person or otherwise. If you register as an emmy, the Personal Information you provide to us may further include such information as your social security number, education and training, including schools attended, degrees and years of graduation, profession and employment, age, gender, life habits, personality, character, driver’s license number, memberships and affiliations. We also collect the credit or debit card information of all Users in order to process payments.
You may also provide us information about specific persons added to your account as “additional users” and/or other parties in your care or on whose behalf you are authorized to request Trip Accompaniment. You agree not to provide us information about any other person unless you have that person’s express permission.

We may collect information about the mobile device or computer you use to access our services, including the hardware model, operating system and version, unique device identifiers and mobile network information.
We may collect information about the location of the device by which you access the Platform if you provide your consent.
We use various technologies to collect Other Information including sending session cookies to your computer or mobile device. Cookies are small data files stored on your hard drive or in device memory that help us to improve our Platform and your experience. You can disable the cookies function through your web browser’s options. If you do not accept cookies, you will not be able to use certain features on our Platform.
The information we collect hereunder, including, without limitation, Personal Information, Other Information, and billing information, is collectively referred to herein as “Information.”
How We Use Your Information
If you provide your own, or are authorized to provide another person’s, Information, we will use it for the purposes for which you provided it and for the purpose of providing our services. We may also use your Information to send you material about products, services, and activities that we or our affiliates think may be of interest to you. If you do not wish to receive one or more types of communications from us, please opt out through the unsubscribe mechanism provided in emails from us, edit your preferences in your profile on our Platform or contact us directly at email@example.com. You may not opt out of certain administrative communications while you have an active User account. In addition, we may use your Information for the following purposes:
- To operate, maintain, and improve our sites, products, and services
- To process and deliver contest entries and rewards
- To respond to comments and questions and provide customer service
- To send information including confirmations, invoices, technical notices, updates, security alerts, and support and administrative messages
- To communicate about promotions, upcoming events, and other news about products and services offered by us and our selected partners
- To link or combine user information with other personal information
- To protect, investigate, and deter against fraudulent, unauthorized, or illegal activity, and
- To provide and deliver products and services customers request
Sharing of Your Information
We may share your Information in order to facilitate confirmation of and communicate with you about requested Trip Accompaniment.
We have contracted with companies to provide certain services on our behalf, including payment processing, website design, hosting, security, text (SMS) messaging and call forwarding, server provisioning and deployment, website operation and maintenance, email delivery, traffic and user behavior analytics and user engagement analytics, and we may share your Information with them solely for purposes of providing our services. We take reasonable steps to ensure that any third party receiving your Information undertakes to (i) retain and use such information only for the purposes set out in this Statement; (ii) not disclose your Information except with your consent, as permitted by law, or as permitted by this Statement; and (iii) generally protect the privacy of your Information.
We also reserve the right to disclose and use Information in special circumstances, including: to comply with law, legal process, law enforcement or other compulsory disclosure; to protect the property, rights and safety of any one; to detect or prevent potential or actual fraudulent or unlawful activity; in connection with a sale, assignment, financing or other transfer of some or all of our assets (including our Platform) or a change in control of Emmyco; to enforce this Statement or the Terms; to respond to your comments or questions; or for other reasons that we determine in good faith are reasonably necessary, appropriate, or required by law.
Children Under Age 13
In accordance with the Terms, you must be 18 years of age to use the Platform. Emmyco adheres to the Children’s Online Privacy Protection Act (COPPA), and we do not knowingly collect any information from children under age 13 through our Platform. If you are a parent or guardian and you believe your child under age 18 may have provided his or her Personal Information to us through our Platform, please notify us at firstname.lastname@example.org.
If we become aware that the security of the Platform has been or may be compromised or any nonpublic user information has been or may be disclosed to unrelated third parties as a result of external activity or otherwise not in accordance with this Statement, we will take measures that we deem appropriate (which may include undertaking an internal investigation, notifying the user, and notifying and cooperating with law enforcement authorities).
Protecting the security of your information is very important to us. When you transmit sensitive Personal Information to our servers, your Personal Information is protected by both a “firewall” (a combination of computer hardware and software that helps keep unauthorized visitors from accessing information within our computer network) and industry standard SSL (secure socket layer) encryption. Nevertheless, no transmission over the Internet can be guaranteed to be 100% secure, and third parties may intercept information without authorization. We make no representation or warranty that the Platform is protected from viruses, security threats or other vulnerabilities or that your Personal Information or Other Information is always secure. Accordingly, you provide us with your Personal Information and Other Information at your sole risk.
Location of Servers and Transfer of Information
The Platform and its servers are located and operated in the United States. If you are located outside of the United States, please be aware that any information you provide to us, including Personal Information, may be transferred to, processed, maintained, and used on computers, servers, and systems located outside of your state, province, country, or other governmental jurisdiction where the privacy laws may not be as protective as those in your jurisdiction. By using our Platform or providing your Information to us, you hereby irrevocably and unconditionally consent to this transfer and to the collection, storage, processing, and use of your Information in the United States.
Under California Civil Code Section 1798.83, California residents who have an established business relationship with Emmyco may choose to opt out of our sharing your Personal Information with third parties for direct marketing purposes. If you are a California resident and (1) you wish to opt out; or (2) you wish to request certain information regarding our disclosure of your Personal Information to third parties for the direct marketing purposes, please send an e-mail to email@example.com.
Emmyco does not monitor, recognize, or honor any behavioral advertising opt-out or do not track mechanisms, including general web browser “Do Not Track” settings and/or signals.
Reviewing and Updating Your Personal Information
You may access, update or correct your profile information at any time by logging into your account. To update, delete, or correct your Personal Information, please log in to your account and use the profile editing function, or contact us at firstname.lastname@example.org. If you wish to delete or deactivate your account, you may do so by visiting your account settings and closing your account, but note that we may retain certain information as required by law or for legitimate business and accounting purposes, for the lifetime of a user relationship and no less than seven (7) years after termination.
